Interstate Migrant Workmen Act

The Interstate Migrant Workmen (Regulation of Employment and Conditions of Service) Act, 1979 (IMWA) is a law enacted by the Indian Parliament to regulate the employment and conditions of service of interstate migrant workmen. The act applies to all establishments that employ 5 or more interstate migrant workmen.

Interstate Migrant Workmen Act Registration

The establishments employing 5 or more migrant workmen have to register as per rule 3 in Form No. I along with necessary fees as prescribed under Rule 12 to the Joint Director-ISH. concerned, through online portal.

  2. Copy of Contract agreements between the Principal Employer and Contractors
  3. Copy of Contractor License issued by concerned authority for recruitment of migrant workmen in home state

Interstate Migrant Workmen Act Licensing

The IMWA requires all contractors who recruit and employ interstate migrant workmen to obtain a license from the appropriate authorities. The licensing process is also relatively simple and can be completed online. The Contractor employing migrant workmen has to apply for licence as per Rule 7 in Form IV or Form V along with the prescribed fees and security Deposit to the concerned Deputy Director-ISH. through online portal.

  1. Form No IV (or) Form No V (downloaded/digitally signed)
  2. Copy of Contract License issued by concerned authority for recruitment of migrant workmen in home state
  3. Form No VI issued by Principal Employer

Interstate Migrant Workmen Act Renewal

Registered establishments and licensed contractors must renew their registration and license every 3 years under the IMWA. The renewal process is also relatively simple and can be completed online. The Contractor employing migrant workmen has to apply for renewal not less than 30 days before the date of expiry of licence in Form IX. along with the prescribed fees to the concerned Deputy Director-ISH, through online portal.

  2. Form No VI issued by Principal Employer
